In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP” or the “Law”), its Regulations (the “Regulations”), and the Privacy Notice Guidelines (the “Guidelines”) among other applicable and current provisions in Mexico, the following is made available to the owner of Personal Data

As the Owner, we inform you of the terms and conditions under which the Xtrader group through any of its companies Xtrader Cross Border S.A.P.I. de C.V., Comercializadora y Distribuidora Xtrader S.A de C.V., and Xtrader Delivery S.A. de C.V., will carry out the processing of the Personal Data that you provide us and that is under our control and reasonable scope of decision, as well as the manner and means under which you may exercise your rights to privacy, informational self-determination and data protection in accordance with the Law, the Regulation, the Guidelines and other applicable legal provisions.

Likewise, we inform you that, during the processing of the Personal Data that you provide us, we will establish the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality and responsibility to which we are subject by the Law and the Regulation.

For all purposes applicable to this Privacy Notice and other issues related to it, the address of Xtrader is located at Boulevard Puerta de Hierro No. 5210, Col. Puerta de Hierro in Zapopan, Jalisco, Mexico CP 45116.

What information do we collect for processing?

The personal data (hereinafter collectively ‘Personal Data’) that you freely and voluntarily provide to Xtrader, will include: (i) Name; (ii) Address; (iii) Email address; (iv) Personal or office landline and/or mobile telephone numbers; (v) Country of Residence; (vi) Nationality; (vii) Occupation; (viii) Marital Status; (ix) Credit Card Data, which in accordance with articles 8, 10 and 37 of the Law, financial data such as Credit Card Data do not require express consent to be used; (x) CCTV (Closed Circuit Television); and (xi) Data of the same nature and exclusively under this category.

We inform you that we do not process personal data of a sensitive nature (‘Sensitive Data’) in accordance with the purposes established in this Privacy Notice.

What do we use your information for?

The Personal Data that we collect and process in accordance with this Privacy Notice will be used for the following purposes that are necessary for the service you request:

(a) Primary Purposes or Necessary Purposes: are those that give rise to or are necessary for the achievement of a potential or past legal relationship between you and Xtrader, that is to say, to: (i) Carry out the contracting of services or acquisition of products that you require; (ii) Carry out the quotation of the various services and/or products that you require; (iii) Carry out the registration of the client in the Xtrader system or correspondents with customs agents; (iv) Deliver requirements in relation to our business needs; (v) Integrate your file as a Xtrader client; (vi) Carry out the corresponding collections for the services and/or products provided and/or supplied by Xtrader; (vii) Identification purposes; (viii) Security purposes through the use of CCTV (Closed Circuit Television); and (ix) Prepare and/or modify contracts, agreements, commercial agreements and/or any other document that provides for the processing of your Personal Data, necessary to give, generate, complete or terminate any commercial, legal or business relationship with Xtrader.

Additionally, we will use your personal information for the following purposes that are not necessary for the requested service, but that allow and facilitate us to provide you with better service:

(b) Secondary Purposes or Non-Necessary Purposes: are those that do not address the commercial, legal or business relationship, that is, to: (i) Evaluate the quality of the products and/or services exchanged; and (ii) Contact you personally, by telephone or by email for marketing, advertising or commercial prospecting purposes.

In the event that you do not agree with the aforementioned purposes, we inform you that you will have a period of no more than (5) five calendar days from the date on which this Privacy Notice is made available to you to express your refusal via email to our Personal Data Office, whose details are provided below.

The rights of the Holder to exercise their rights to revocation are preserved.
